Grants of Probate
We prepare all the documentation necessary to apply for Grant of Probate and provide you with important guidance and support along the way. We understand that our clients require the utmost assistance in these difficult circumstances, not to mention that it can also be confusing and overwhelming being named an Executor in the Will. At Surge Legal your matter will always be handled with care and diligence and we will stay in contact with you every step of the way. We offer reasonable fixed fee options for these matters so you will always have peace of mind regarding the outcome of your application and your legal fees. Get started with a matter relating to an Application for Probate by arranging a Free Initial Consultation with our office.
Family Provision Claims
If you are unsure whether or not you are entitled to receive a part of the Deceased Estate, we carefully assess your individual circumstances and provide detailed advice to you as to the prospects of success of your Family Provision Claim. This is a complex area of law and you need to have a qualified lawyer by your aside, whom you can trust. Unlike an Application for Probate or Letters of Administration, matters relating to potential Family Provision Claims need to be carefully assessed during a comprehensive conference with our clients and do not generally qualify for a quick free consultation. If you would like assistance with the above, you will need to organise an in-depth consultation (at least for 1 hour) so that we can properly assess your circumstances and advise you of your rights pursuant to the Succession Act 2006 (NSW).
Letters of Administration
If your loved one has passed away without a Will, we are able to apply for a Grant of Letters of Administration to the Supreme Court of New South Wales. This document allows the administrator to manage and distribute the deceased's assets. Wills
At the time of your initial appointment in relation to preparing a Will, we will ask you to provide us with the full names of all Beneficiaries (persons receiving a share in your estate) and Trustees / Executors (persons in charge of administration of the estate). You should also be ready to provide detailed instructions as to how you wish to divide your estate between the beneficiaries. We will also provide you with comprehensive advice in relation to various estate planning options you may have prior to you executing a Will. We are proud to announce that in order to accommodate our clients we also offer special Saturday appointments for execution of Wills, Powers of Attorney and Enduring Guardianships. Give us a call now on 02 8722 5021 to schedule your appointment!
Powers of Attorney
Do you need a document allowing someone else to manage your financial affairs? There are many circumstances that warrant such authority being provided to a friend or family member. We are able to prepare a Power of Attorney or Enduring Power of Attorney in accordance with your instructions and address all issues commonly associated with drafting and executing these documents.
Enduring Guardianships
We are able to assist you in drafting and executing an Enduring Guardianship allowing your nominated guardian to make lifestyle decision on your behalf when you lose capacity to make those decisions. We will prepare this document in accordance with your instructions and address all issues commonly associated with drafting and executing Enduring Guardianships.
